The wiki says 18-19, I’m going to go with 18. (EDIT: the wiki hasn’t been updated in a while so actually davina is at least 20, probably 21) Either way she’s not underage and could completely consent. Some people are saying its OOC and I can understand that but consider this.
Kol has been dead for what - a year? - lets go with a year. They were together for what I assume was a little less than a year (maybe 9ish months I don’t know) before he died. So I think we can all agree that they’ve been together for quite some time. Davina is fully aware of who Kol is and that she definitely isn’t his first. But in a way she is his first; his first real love, his first connection to humanity, the first and probably the only person he will love so selflessly because they fell for eachother when he was human(ish). So their connection is enough that taking that next step isn’t so out of character.
As for Kol, there is no way in hell he would have let Davina do something she wasn’t ready for. He loves her so much and sex isn’t the most important thing to him in this relationship so he would have not have allowed it if he didn’t believe davina was a fully ready, consenting adult.
I will admit that I believe the scene probably happened a bit too early so I can understand people’s hesitation. Kol had only just got back and you can see Davina is still trying to sus out whether Kol is still the man she remembers. But if it hadn’t happened this episode it would have happened the next one or the one after that.

Brotp all the way. They have the best chemistry and Rebekah was so tirelessly attempting to bring Kol back that it broke my little heart. In the last episode practically the first word’s out of Kol’s mouth after hello to his siblings were “where the fuck is rebekah?”. I can just see Kol, Rebekah and Freya being this adorable little Mikaelson trio. I think the three of them will really connect.
